Gas Royalty Lawsuits

In recent years, a number of royalty owners have learned that they have been substantially underpaid by petroleum producers that are obligated to pay them royalties on gas production. Landowners who execute leases for the production of gas usually bear the right to a fractional share of the production. Depending on the terms of the lease and/or the law of the applicable state, certain costs of treating and processing the gas may be deductible by the gas producer as it calculates the fractional share owed to the royalty owners. Disputes have arisen as to the propriety of deductions, including the dollar amount of individual deductions and whether certain deductions should have been taken at all.
